General Terms and Conditions of Sale

2. Scope

These General Terms and Conditions of Sale govern orders placed on the website by customers acting as consumers. They are available before ordering and must be accepted in order to complete the purchase.

The applicable terms are those in force on the date of the order. Mandatory provisions of consumer law remain applicable in all circumstances.

3. Products

Maison Molinet offers, in particular, wines, spirits, beverages, fine food products, teas, wellness products, gifts and accessories. Essential characteristics, volume, price and, where relevant, vintage, ingredients or allergens are shown on the product page.

Photographs are produced or selected with care but may show slight differences in colour, label or packaging without altering the product’s essential characteristics. In the event of a substantial change, Maison Molinet contacts the customer before dispatch.

4. Sale of alcoholic beverages

The sale of alcohol to persons under 18 is prohibited. By ordering an alcoholic beverage, the customer declares that they meet the legal age requirement. Proof of age may be requested.

Alcohol abuse is dangerous for your health. Drink responsibly.

5. Prices

Prices are stated in euros, including all taxes, excluding delivery charges. Applicable delivery charges are shown before the order is finally confirmed.

Maison Molinet may change its prices at any time, but products are charged at the price displayed when the order is confirmed, subject to correction of an obvious error.

6. Orders

The customer selects the products, checks the basket, provides the requested information, chooses a delivery and payment method, and then confirms the order after having had the opportunity to correct any errors.

The order becomes final after payment has been validated and the order confirmation has been sent, subject to availability, fraud-prevention checks and the absence of an obvious error.

Maison Molinet may refuse or cancel an order for a legitimate reason, including unavailability, a payment incident, suspected fraud, a manifestly incorrect address or an abnormal order.

7. Availability

Offers are valid while stocks last. If a product becomes unavailable after an order has been placed, Maison Molinet will inform the customer as soon as possible and, depending on the customer’s choice and where possible, offer an equivalent product, a credit note expressly accepted by the customer or a refund of the amount concerned.

8. Payment

The available payment methods are those displayed during checkout. They may include bank cards and digital wallets enabled on the store, such as Shop Pay or Apple Pay.

Payments are processed by secure service providers. Maison Molinet does not receive the full bank-card number used for payment.

9. Delivery

Delivery areas, methods, prices and times are detailed in the Shipping Policy and displayed before the order is confirmed.

The customer must provide an accurate and accessible address. Where delivery is carried out by a carrier offered by Maison Molinet, the risk of loss or damage passes to the consumer when the consumer, or a third party designated by the consumer other than the carrier, physically takes possession of the goods.

10. Right of withdrawal and returns

Consumers generally have 14 days from receipt of the goods to exercise their right of withdrawal, subject to the exceptions provided by law.

The conditions for exercising this right, exclusions, return procedures and refund arrangements are detailed in the Return and Refund Policy, which forms an integral part of these terms.

Bottles of wine or spirits are not automatically excluded from the right of withdrawal. Subject to applicable legal exceptions, they must be returned unopened, intact and in a condition suitable for resale.

11. Statutory guarantees

Consumers benefit from the statutory guarantee of conformity provided for in Articles L.217-3 et seq. of the French Consumer Code. This guarantee applies for two years from delivery of the goods, under the conditions laid down by law.

Consumers also benefit from the guarantee against hidden defects provided for in Articles 1641 et seq. of the French Civil Code. Proceedings must be initiated within the statutory period from discovery of the defect.

These statutory guarantees are independent of any commercial guarantee that may be offered.

13. Liability and force majeure

Maison Molinet performs its obligations within the limits provided by law. Its liability cannot be excluded or limited where a mandatory legal provision prohibits this.

Neither party may be held liable for delay or non-performance resulting from an event of force majeure within the meaning of French law. The affected party will inform the other party as soon as possible.

14. Personal data

Data required for order processing and customer relations are processed in accordance with the Privacy Policy.

15. Consumer mediation

The customer must first address any complaint to Maison Molinet. If no amicable solution is found, the customer may use the designated consumer mediator free of charge:

16. Applicable law and disputes

These terms are governed by French law, without depriving consumers of any mandatory protection available in their country of residence where applicable.

If no amicable agreement or mediation is reached, the dispute falls within the jurisdiction of the competent courts determined in accordance with the applicable legal rules. Nothing in these terms limits the consumer’s right to bring a matter before the competent court.
