General conditions of sale

2. Scope

These general conditions of sale govern orders placed on the site by customers acting as consumers. They are accessible before ordering and their acceptance is required to finalize the purchase.

The applicable conditions are those in force on the date of the order. The mandatory provisions of consumer law remain applicable in all circumstances.

3. Products

Maison Molinet offers wines, spirits, drinks, delicatessen products, teas, wellness products, gifts and accessories. The essential characteristics, capacity, price and, where relevant, the vintage, ingredients or allergens are presented on the product sheet.

The photographs are taken or selected with care but may present slight differences in color, label or packaging, without modification of the essential characteristics of the product. In the event of a substantial change, Maison Molinet contacts the customer before shipment.

4. Sale of alcoholic beverages

The sale of alcohol is prohibited to minors under 18 years of age. By ordering an alcoholic beverage, the customer declares to be of the required legal age. Age verification may be requested.

Alcohol abuse is dangerous for your health. Consume in moderation.

5. Price

Prices are indicated in euros, all taxes included, excluding delivery costs. Applicable fees are presented before final validation of the order.

Maison Molinet may modify its prices at any time, but a product is invoiced at the price displayed when the order is validated, subject to the correction of a manifest error.

6. Order

The customer selects the products, checks their basket, provides the requested information, chooses a delivery and payment method, then confirms the order after being able to correct any errors.

The order becomes final after validation of payment and sending of the order confirmation, subject to availability, checks related to fraud prevention and the absence of obvious error.

Maison Molinet may refuse or cancel an order for a legitimate reason, in particular in the event of unavailability, payment incident, suspicion of fraud, obviously incorrect address or abnormal order.

7. Availability

Offers are valid while stocks last. If a product becomes unavailable after the order, Maison Molinet will inform the customer as soon as possible and offer, according to their choice and when possible, an equivalent product, an expressly accepted credit or reimbursement of the amount concerned.

8. Payment

The payment methods available are those displayed when placing the order. They may in particular include the bank card and digital wallets activated on the store, such as Shop Pay or Apple Pay.

Payment is processed by secure providers. Maison Molinet does not receive the full number of the bank card used for payment.

9. Delivery

The areas, methods, prices and delivery times are detailed in the Shipping Policy and displayed before validation of the order.

The customer must provide an accurate and accessible address. When delivery is made by a carrier offered by Maison Molinet, the risk of loss or damage is transferred to the consumer at the moment when he, or a third party designated by him other than the carrier, takes physical possession of the goods.

10. Right of withdrawal and returns

The consumer has in principle a period of 14 days from receipt of the goods to exercise his right of withdrawal, subject to the exceptions provided for by law.

The conditions of exercise, exclusions, return and refund procedures are detailed in the Return and Refund Policy, which forms an integral part of these conditions.

Bottles of wine or spirits are not automatically excluded from the right of withdrawal. They must be returned unopened, intact and in a condition allowing them to be resold, subject to applicable legal exceptions.

11. Legal guarantees

The consumer benefits from the legal guarantee of conformity provided for by articles L.217-3 et seq. of the Consumer Code. This guarantee applies for two years from delivery of the goods, under the conditions provided for by law.

The consumer also benefits from the guarantee against hidden defects provided for by articles 1641 et seq. of the Civil Code. The action must be initiated within the legal time limit from the discovery of the defect.

These guarantees are independent of any commercial guarantee that may be offered.

13. Liability and force majeure

Maison Molinet responds to its obligations within the limits provided by law. Its liability cannot be waived or limited when a mandatory legal provision prohibits it.

No party can be held responsible for a delay or non-performance resulting from an event of force majeure within the meaning of French law. The party concerned shall inform the other party as soon as possible.

14. Personal data

The data necessary for order processing and customer relations are processed in accordance with the Privacy Policy.

15. Consumer mediation

The customer must send his complaint to Maison Molinet as a priority. If no amicable solution is found, he can contact the designated consumer mediator free of charge:

16. Applicable law and disputes

These conditions are governed by French law, without depriving the consumer of the mandatory protections from which he benefits in his country of residence when these are applicable.

In the absence of an amicable agreement or mediation, the dispute falls under the jurisdiction of the competent courts determined in accordance with the applicable legal rules. No clause in these conditions limits the consumer's right to refer the matter to the competent court.
